Java-E UK - Consumer Rights (Distance Selling)
As well as being covered by the normal various consumer acts, distance selling is also covered under the Consumer Protection (Distance Selling) Regulations 2000.
Distance selling is where the company/department that you're buying from is not setup to normally deal with you face-to-face. Phoning an order into a shop after you saw it in the shop is not distance selling and is just covered by the other various consumer acts.
Distance selling includes mail-order, and Internet sales.
For distance selling, the seller must let you know all of the following BEFORE you are committed to make payment:
1. A fair and accurate description of the goods/services.
2. The price of the goods/services (INCLUDING taxes and delivery charges).
3. How long the price is open/valid for.
4. Details of Delivery Arrangements.
5. Details of Payment Arrangements.
6. Your rights to cancel the order.
7. Your liability for costs incurred in the event of a refund/return for a change of mind.
8. The duration of the contract (if it's a service rather than a product).
9. The name and address of the selling company.
For distance selling, the seller must let you know all of the following AFTER you have committed to making payment:
1. Confirmation of your Order.
2. Instructions/information about how to cancel your order.
3. Details about any guarantees and warranties.
4. Details about any After-Sale service.
5. Details about how to cancel a service contract if no definitive dates are relevant to that contract (eg Lifetime Services).
6. All of the pre-purchase points shown above which have not already been told to you.
(You should get all of this information BEFORE you receive the product)
Delivery should occur within 30 days of payment unless you are told otherwise before you purchased the item. have committed to making payment:
"Letting you Know" this information can be done by postal letter, fax, or email. Simply displaying it somewhere on a web-site is not sufficient.
