If an item is not defective, but is not compatible for your personal purposes (e.g. computer software which is for a different operating system than you have at home), then unless you asked the seller beforehand if it's compatible with your personal purpose (AND they gave you the wrong answer), the seller is not obliged to give you any refund/exchange. If the item is fit for the purpose for which it was sold, then you should ask before you buy it whether or not it will be compatible.

In most instances a seller will exchange the product if it's not compatible for your personal purpose, but such an exchange is just a goodwill gesture on the part of the seller, and it's quite reasonable that they refuse a refund/exchange (especially if the item has been opened or is copyable).

The burden of whether or not an item that you buy will be compatible for your own purposes is mostly on the buyer who should ask the seller the relevant questions and agree with the seller the element of risk of incompatibility and the circumstances of refunds/returns/exchanges.
